The RDEK is committed to protecting the privacy of any personal information you may provide when visiting our website. Part of that commitment is to explain what information may be collected and why, how it will be used and who may have access to it. Our practices have been designed to ensure compliance with the privacy provisions of the Freedom of Information and Protection of Privacy Act (FOIPPA). Any personal information you provide to us is collected, used and disclosed in accordance with FOIPPA.
The purpose of this privacy statement is to inform you of the personal information that may be collected, used, and disclosed when you visit our site, and all associated systems, processes and applications under the direct control of the RDEK.

In Short: We collect personal information that you provide to us.
When you visit the RDEK's website, you do so anonymously there is no need to tell us who you are. The RDEK does not automatically collect any personal information, such as your name, phone number, address, or email. Personal information is only obtained if you supply it voluntarily through contacting us via email, online forms, or by providing consent.
Any personal information that we do collect from you will only be used for the purpose of administering our services, informing you of our services, projects and initiatives, and for statistical purposes.
The RDEK is the sole owner of the information collected on its website. We will not sell, share, rent or otherwise disclose your personal information to any organization or individual, unless we notify you and obtain your consent.
2. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
In Short: We only process your personal information when it is necessary and we have a valid legal basis to do so under applicable law, like with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill our legitimate business interests.
We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.
3. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: We may use cookies and other tracking technologies to collect and store your information.
Like many site operators, we collect information that your browser sends whenever you visit our site, called Log Data. Some of the services available from the RDEK's website may require the use of "cookies". The RDEK's website uses "per-session" cookies only. Per-session cookies are small files that are temporarily stored in your computer's memory and are deleted when you leave the RDEK's website.
4. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill intended purposes.
We will only keep your personal information for as long as it is necessary for the purposes set out, unless a longer retention period is required by law.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

The RDEK is obligated to protect your personal information by making reasonable security arrangements against such risks as unauthorized access collection, use, disclosure or disposal. Security measures have been integrated into the design, implementation and day-to-day operating practices as part of the RDEK's commitment to the protection of personal information it holds. The security of your personal information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

The following Terms and Conditions govern the use of Engage East Kootenay (“the site”). The software platform is owned by Social Pinpoint Pty Ltd and operated by us, Regional District of East Kootenay.
By accessing and using this site, you are choosing to accept and comply with the Terms presented throughout this agreement as well as the Privacy Policy and Moderation Policy. These Terms apply to all visitors and users of this site. Linked sites, affiliated services or third party content or software have their own Terms that you must comply with. If you disagree with any of the Terms presented in this agreement, you may discontinue using the site immediately.
If you are under 18 years old, please ensure that your parent or guardian understands and accepts these Terms and Conditions (including the Privacy Policy and Moderation Policy).
What are the conditions with a user’s account?
While using the site, you must not violate any applicable laws and regulations. It is our duty to protect the confidentiality of content you provide on our site in accordance with our Privacy Policy. When you create an account with us, you must always provide us with accurate information. Failure to provide accurate information violates the Terms, which may result in immediate termination of your account on our service. You are responsible for protecting your own password you use for this site and for any activities done under that password. We may terminate or suspend access to your site and/or account immediately, without prior notice, including without limitation if you breach the Terms. We may immediately deactivate or delete your account and all the related files and information in your account. After your account has been terminated, the content you have posted may also remain indefinitely on the site.

Governing Law
These Terms shall be governed in accordance with the laws of the State of Delaware, the United States of America and Queensland, Australia, without regard to its conflict of law provisions.
Indemnification
Regional District of East Kootenay, its subsidiaries, affiliates, officers, agents, licensors and other partners are not responsible for any loss, liability, claim, or demand, including legal fees, made by any third party due to or arising from a breach of this agreement and/or any breach of your representations and warranties set forth above.
What content do we own?
This website contains the copyrighted material, trademarks, patents, trade secrets and other proprietary information (“Intellectual Property”) of Regional District of East Kootenay and its suppliers and licensors. Regional District of East Kootenay owns and retains all proprietary rights in the intellectual property. All intellectual property in the content of this site including without limitation to text, software, source code, pages, documents and online graphics, photographs, sounds, audio, video and other interactive features are owned by or licensed to us.
Any original content that you submit or post on our site may be made available to the public and allows users to share your content (with the end user acknowledging your contribution) under the Creative Commons Attribution-ShareAlike 4.0 License.
Except for Intellectual Property which is in the public domain or for which you have been given written permission, you may not copy, alter, transmit, sell, distribute any of the Intellectual Property on this site.
We are not responsible for your communications or dealings, including payment and delivery of goods or services, with a third party found via our website. Any loss or damage incurred from those communications or dealings are solely between the user and the third party.
